Declaration of Presence — for non-EU students staying under 90 days

If you are a non-EU student and you come to Italy for less than 90 days, in most cases you don't need a Residence Permit — the Declaration of Presence at the Questura within 8 days of arrival is enough.

Legal reference: Law 68/2007. Applies to tourist stays, short study mobility, summer programs.

01When it applies (and when not)

The Declaration of Presence is valid for non-EU students in these situations:

• You are in Italy for less than 90 days (summer program, short intensive).
• You are enrolled at a university in the European Union (Schengen Area) and already hold a study residence permit from another EU State covering your whole mobility period.
• You take part in a European mobility programme (Erasmus) or international-agreement mobility.
• You are visa-exempt based on your nationality (e.g. USA, Canada, Japan, Australia for tourist stays).

It does NOT apply if you come with an Italian study visa for more than 90 days — in that case you must file the Residence Permit.

02How to do it — two scenarios

Entering Italy directly from a non-Schengen country (e.g. USA, UK, Brazil, India)

The entry stamp on your passport from the border police (Malpensa, Fiumicino, Marco Polo airports) already counts as a Declaration of Presence. Keep the stamped passport — nothing else is needed.

Entering Italy from another Schengen country (e.g. via Vienna, Paris, Munich)

You must file the Declaration of Presence at the Questura of the province where you stay, within 8 days of arrival. The form is called "Dichiarazione di Presenza ex art. 5, comma 7, D.Lgs. 286/1998".

03What to bring

• Filled form (download from the box above or from your provincial Questura website).
• Original passport + photocopy (personal data page + Schengen entry page, if any).
• Proof of accommodation: hotel receipt, declaration of hospitality from the host, student residence booking.
• Sufficient financial means: bank statement, cash, guarantee letter.
• Health insurance valid in Italy for the entire stay.

04Where to go — Questura Ufficio Immigrazione

Submit the Declaration at the Immigration Office of the provincial Questura. Always book online at prenotafacile.poliziadistato.it (SPID/CIE required) before going.

05Cost

The Declaration of Presence is free. No revenue stamp, no payment. The Questura issues you a stamped receipt.
